NON-COMMERCIAL FONT LICENSE AGREEMENT

This Non-Commercial Font License Agreement ("Agreement") is a binding legal agreement between you ("Licensee") and Mikah Smith ("Licensor"), the sole copyright holder and intellectual property owner of the font software and design ("Font"). By downloading, installing, copying, or using the Font, you agree to be bound by the terms of this Agreement.

1. GRANT OF LICENSE
Licensor grants Licensee a non-exclusive, non-transferable, non-sublicensable, revocable license to use the Font for personal and non-commercial purposes only. This includes, but is not limited to:
- Personal art or design projects not offered for sale or monetization.
- Personal websites or blogs that generate no ad revenue or profit.
- Educational projects not intended for sale or commercial use.

2. PROHIBITED USES
The Licensee may not:
a. Use the Font in any commercial context, including advertisements, product packaging, merchandise, commercial websites, or revenue-generating projects.
b. Sell, rent, lease, license, or sublicense the Font or derivative works.
c. Embed the Font in software, hardware, or mobile apps offered commercially.
d. Modify the Font and redistribute it, whether modified or unmodified.
e. Use the Font in logos or trademarks without prior written permission.
f. Share the Font on font repositories, marketplaces, or any public distribution platform.

3. OWNERSHIP AND COPYRIGHT
The Font is protected by United States and international copyright and intellectual property laws. Title, ownership, and all rights in and to the Font remain exclusively with Mikah Smith.

4. TERMINATION
This license is effective until terminated. It will terminate automatically without notice from the Licensor if you breach any term of this Agreement. Upon termination, you must cease all use of the Font and delete all copies.

5. DISCLAIMER OF WARRANTIES
The Font is provided "AS IS" without warranties of any kind, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose. Licensor shall not be liable for any damages arising from the use or inability to use the Font.

6. LIMITATION OF LIABILITY
Under no circumstances shall Licensor be liable for any incidental, special, indirect, or consequential damages, including but not limited to lost profits or data, even if advised of the possibility of such damages.

7. GOVERNING LAW AND JURISDICTION
This Agreement shall be governed by and construed in accordance with the laws of the United States of America and the State of Washington, without regard to conflict of law principles.
Any legal action or proceeding arising under or in connection with this Agreement shall be brought exclusively in the state or federal courts located in Spokane County, Washington, and Licensee hereby consents to personal jurisdiction and venue therein.

8. DISPUTE RESOLUTION
Before initiating any legal proceedings, both parties agree to attempt to resolve disputes through informal negotiation.
If unresolved within 30 days, the parties shall submit the dispute to binding arbitration in Spokane, Washington, under the rules of the American Arbitration Association. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

9. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between the parties with respect to the Font and supersedes any prior agreements or understandings, whether written or oral.

By installing or using the Font, you acknowledge that you have read, understood, and agree to be bound by the terms of this License.
